I have a film making its world premiere at the Mill Valley Film Festival. It's called "Compound Eye" and it centers around a cartoonist who draws a controversial comic strip depicting the World Trade Center rebuilt as an IHOP with two stacks of pancakes rising high into the sky, and how it affects his roommate who is trying to quietly run a pirate radio station out of his basement. The movie stars Fausto Caceres (from the radio show, Shirley and Spinoza) and Jesse Reklaw (the cartoon, "Slow Wave"), and uses their real lives and weaves them into a fictional story.

The screenings are:
Sometimes I get nostalgic. I moved a lot in my life, an average of once every two years. I went to ten schools in thirteen years (K-12), and the one thing that was a constant was music. Music and TV. The two things that were constant were music and TV. And family. The three…three things that were constant were music, TV, family and the ever increasing amount of sarcasm that made it into my humor.
A Season In Hell #12: Waiting for the Man

***Warning*** Because of the need for server space, I will be removing Episode #1 and possibly #2 by Thursday, August 2nd, 2007. You have been warned.

I spent a year in DC last week. I was there for an education conference, and I had the luxury of seeing the New York Dolls perform at the legendary 9:30 Club. The club has been open since the 70’s, but obviously in a very different location. What a great club; amazing sound and stage. The Dolls were incredible too. Only Sylvain and Johanson are alive from the original lineup, but the rest of the band seriously kicked ass. They have a new CD out, go get it.

I got to walk “The Mall”, which is the federal gov’t area. Quite impressive, even if you don’t like the schmuck who lives in the white house right now.

This week I include some early NY Dolls. I also have some live tracks from Tom Waits with the Kronos Quartet doing the theme to my favorite show: “The Wire”. If you haven’t seen this great police drama on HBO, you’re missing the best written show on TV. Some live Lou Reed shows up near the end of the podcast today. A real rarity is included in the guise of Neil Young. He never released “Chrome Dreams”, but all of the music made it on to something eventually. This version of “Powderfinger” never did.

I hope you enjoy the show. Please leave a comment on the website: http://johnhell.podomatic.com and tell your friends about thee show by clicking the “send to friends” link on the page.
I've just posted my latest podcast: A Season In Hell #4: Everything Goes To Hell.

It runs about an hour. It's certainly not the same as radio, but I do try to make it sound like it is. It lacks the spontanaiety of radio that I miss so much. Other than that, I get to turn you all onto music that I love. I found some good new sounds to mix with some tasty classics from my collection.
I am so pleased to announce my triumphant return to…dang, that sounded a bit blech! Let me start over.
Good friends:

You’ll be happy to hear…like I’m expecting you all to slap me on the back or something. Ok, I’ll get it right this time.

Party People:

We’re going to have a funky good time at KFJC 89.7fm (http://kfjc.org), this Thursday, May 3rd from midnight to midnight, with the long anticipated 24 hour “Doing It To Death, A James Brown Birthday Special”, featuring live & rare recordings, interviews, dance contests, fashion show, testimonials and tributes. Hosted by Myself, Spliff Skankin, Hawkeye Joe, KJ Dweller, Mr. Lucky & more.

I’ll be on from 8pm to midnight, bringing the show to its absolute climax with some rare JB’s James Brown instrumentals, and some serious live James Brown you have not heard anywhere!

I hosted several radio shows at KFJC between 1988 and 1997 under the air name Reverend Dah Wave, including a mid-day Jazz/Soul/Funk show, where every day from noon to noon-thirty it was “The Brown Bag Lunch”, 30 minutes of Mr. Please, Please, Please itself. I haven’t done a show there since 1999. It’s the best station in the West, and other than the great WFMU, the tops in all the land.

If you’re close to Foothill JC, in the SF Bay Area, tune in to 89.7FM, if you’re outside the area, please do yourself the favor and tune in any time during the show. Remember: midnight to midnight. You have no excuses.

Now, go on out and do you thang!

Finally after three years of waiting SFLR will have it's day in the
Ninth Circuit. This is where we could actually make some change!
Everyone who can should come on down to see the deftness of our
fantastic legal team! We will have stickers available to show your
support.

SFLR vs. FCC: Head to head, oral arguments!
February 14, 2007, 9:30 AM, Booth Auditorium at UC Berkeley School of
Law (Boalt Hall, located on Bancroft Way at College Ave. /
http://www.berkeley.edu/map/maps/DE67.html )

The Ninth Circuit Court of Appeals will hear oral argument from lawyers
representing long time media activist San Francisco Liberation Radio.

SFLR was raided in October, 2003 when federal marshals, SFPD and FCC
agents stormed into the home where the station was located, with guns
drawn, and seized SFLR’s broadcasting equipment in order to prevent
SFLR from broadcasting. SFLR will argue (through its counsel, Mark
Vermeulen, and other pro bono lawyers from the National Lawyers Guild)
that the federal government violated the station’s and its
listeners’
First Amendment rights when it obtained the warrant for the raid and
the seizure of the equipment through a back-door, ex parte procedure.
In civil seizure cases (as opposed to criminal cases), fair notice and
a hearing before a judge typically must take place before any raid can
go forward. This is especially true where First Amendment free speech
rights are involved. However, here, the US Government here utilized a
maritime law to conduct the raid without giving advance notice to the
station, arguing that a radio station is like a ship that may sail away
in the night.

The station, with a volunteer staff of nearly 60 people, was located in
a house firmly rooted upon land and posed no danger of trying to
“escape,” nor was it interfering with any other station’s
broadcasts.
It had been broadcasting at 100 watts in San Francisco for 11 years and
had been in consistent contact with the FCC regarding licensing
matters. The Court will decide whether the government has the right to
obtain from the District Court an ex parte order to raid a radio
station, and seize the equipment even where as in our case, our lawyer
had explicitly requested notice if such action was contemplated.

This hearing is the next step in three years of legal proceedings in
this case, and may well effect how the rights of others challenging FCC
regulations are observed (or not) in the future.

Happy Halloween!!

This Halloween we have a real ghoul on our hands! The rule relaxations of 2003 are being re-proposed and we need to give the FCC a peice of our minds AGAIN!

The FCC is coming to Oakland October 27, 5 pm!
This is the only hearing in the Bay Area dealing with corporate media consolidation and lack of diversity in the media. The FCC wants to allow Big Media to own more TV and radio stations in the Bay Area and to allow newspaper companies to buy TV and radio stations as well. Stop the monopoly!

Please come to hear from others and speak up. Spread the word!

WHAT: FCC Hearing on Media Ownership
WHEN: Friday October 27, starting at 5 pm
WHERE: Oakland Marriott City Center, 1001 Broadway at 10th St (BART Oakland 12th St, map)
Sponsored by the NAACP, Media Alliance, the Youth Media Council, and Free Press
(more info at www.media-alliance.org)

This is Why the FCC Needs to Hear from You!

There's no diversity in TV
• NBC's Telemundo announced last Friday that it will close its San Jose studio and it will no longer offer local news in the Bay Area.
• Out of an estimated 12,500 stories aired by ABC, CBS, and NBC in 2005, the three major English-language networks, only 105 were exclusively about Latinos or Latino-related issues.
• People of color comprise 33 % of the entire U.S. population, but own about 3% percent of all TV stations in the U.S. Clear Channel spreads hate in the Bay Area
• Clear Channel exploited a loophole in this rule and owns 11 radio stations in the Bay Area market (San Francisco, San Jose, Oakland).
• Clear Channel owns 910AM KNEW, a right-wing talk station notorious for its sensational content. The Youth Media Council and Media Alliance monitored KNEW and found numerous incidents of hateful speech. For example, talk hosts used the word 'vermin' to refer to undocumented immigrants more than 43 times in one 40-minute segment.
There's a monopoly in Bay Area print
• One company (Dean Singleton's MediaNews) now controls more than 40 daily and weekly newspapers in Northern California—from Monterey to Marin--including the San Jose Mercury News, the Oakland Tribune, the Contra Costa Times, the Monterey Herald, the Marin Independent Journal. In other words, every major daily except for the SF Chron, the Examiner, and the Santa Rosa Press Democrat.
• Singleton's company has already announced over 100 layoffs in the Mercury News; more to come in the Contra Costa Times.
NOW THE FCC WANTS TO REWARD THE TV NETWORKS, CLEAR CHANNEL, AND DEAN SINGLETON WITH MORE AND MORE STATIONS.

STOP THE MONOPOLY!

For more information, go to www.media-alliance.org or call 510-832-9000 ext 303

Anyone know if micro radio played a role in helping the Puerto Rican independence activists in the following story? Just wondering about the uses for mobilization.
----------------

FBI commits domestic terrorism on Independence Movement in Puerto Rico

"The only domestic terrorist attack here is the U.S. government's attack on
the people of Puerto Rico." --New York State Assemblyman José Rivera (1)

In a move reminiscent of a U.S. Marine invasion of a foreign
country, the FBI descended in droves on Puerto Rico on February 10. (2)
Without breathing a word of the invasion to either the colonial governor or
the chief of police, heavily armed, militarized units of the FBI, including
the Special Weapons and Tactics Unit from Miami, hit six different spots
throughout the island. Their purpose, they claimed, was to execute search
warrants on six independence activists they identified as suspected leaders
of the clandestine independence organization, Ejercito Popular Boricua/
Macheteros (3), the same organization whose legendary leader, Filiberto
Ojeda Ríos, who the FBI assassinated five months earlier. Their true
purpose was widely understood as other: with their show of force, to
continue their long campaign to intimidate and criminalize those who support
independence for Puerto Rico, particularly in this moment of the resurgence
of the left throughout Latin America; and, of course, to detract from their
own criminal conduct in taking Ojeda's life. "This is yet another move on
the part of the FBI to control and warn those who advocate for the
independence of Puerto Rico, exercising their constitutional rights. It
appears they are sending a message of intimidation,"(4) said independentist
activist and attorney Roxana Badillo, who added that they are sorely
mistaken if they believe the movement will be intimidated.

Landing in military-style helicopters, accompanied by caravans
of vehicles, sometimes with the license plates obscured, FBI agents swarmed
private residences and businesses in Trujillo Alto and Río Piedras (in the
San Juan metropolitan area), and Mayagüez, San Germán, Aguadilla, and
Isabela (in the west of the island), terrorizing entire neighborhoods. The
search warrants bore the names and addresses of veteran labor leaders,
community leaders, known independentists, and even a Protestant minister
respected for his work promoting small projects of self-empowerment for poor
people. (5)

In Río Piedras, as Homeland Security helicopters hovered above
and sharpshooters watched through their telescopes from neighboring
buildings, FBI agents were ransacking the apartment of independentist
Liliana Laboy. The Puerto Rican media arrived to cover the remarkable
event. With the FBI's murder of Ojeda Ríos fresh on their minds,
independence supporters quickly gathered at the closed gates of the
condominium, shouting, "Asesinos!"(6) Meanwhile, the FBI had banished Laboy
from her apartment, and initially ignored requests from her attorneys to
allow them access to their client, grabbing and threatening to arrest the
attorneys if they didn't leave the premises.

In San Germán, agents assaulted the offices of the not-for-profit
Ecumenical Committee for Community Economic Development [CEDECO,
its Spanish acronym], where community activist and independentist
William Mohler García was at work. They not only removed Mohler from his
office, but they handcuffed him and left him to bake in the hot sun– this,
after searching his home, pepper spraying his dog, and subjecting his wife
to much humiliation. Supporters gathered at the scene, shouting at the
agents: "Get out of here, damned FBI," and "FBI, cowards, assassins,
terrorists!" (7) In Aguadilla, the FBI searched the home of another CEDECO
director, Presbyterian minister and independentist José Morales. Also in
Aguadilla, the FBI spent four hours searching the home of independentist and
elementary school teacher VilmaVélez Roldán, while she was at school.
Agents threw her two sons out of their home, handcuffed them, and left them
outside with no shade. (8) In Isabela, the Cabán family home was searched.(9)

In Trujillo Alto, the home of Norberto Cintrón Fiallo was ransacked while he
was away at his workplace.

Before leaving the scene in Río Piedras, the FBI, obviously
unhappy with the presence of protesters and abundant numbers of media and
the prospect of having to face further public exposure, aggressing against
all those gathered, including attacking the media with pepper spray.
Several journalists were treated by paramedics at the scene, and some went
to nearby hospitals. As the caravan of some fourteen vehicles sped from the
scene, the agents had their assault weapons pointed at the press and public.

Adding insult to injury, the FBI emitted a press release stating, "It
appears members of the media and the general public attempted to cross the
established law enforcement perimeter, and the use of non-lethal force was
utilized. This was done in order to protect members of the media, the public
and the law enforcement officers executing this lawful search warrant."

Reaction from the Press

"It gives us pause that in a democratic society, security forces
cut off the flow of information, and even worse, attack those who work in
journalism, who seek to divulge precise and reliable information," said
Annette Alvarez, a television reporter who was sprayed, who spoke in her
capacity as president of the Overseas Press Club chapter. (10) Oscar J.
Serrano, president of the Journalists Association of Puerto Rico, declared,
"The agents didn't use force and gas to defend themselves; they used them
offensively to attack the press. The act of an agent emptying his spray can
directly in the face of [journalist] Normando Valentín, who had his hands
occupied with the instruments of his trade, cannot be excused as negligence.

That, and the expression of disdain reflected on the agent's face, are
indicative of a specific intent to cause harm, and represents nothing less
than a criminal act."(11) The Association of Photojournalists, the Center for

the Freedom of the Press, the Organization of Independent Journalists, and
the Union of Journalists, Graphic Arts and Ramas Anexas joined in
condemning the FBI's use of force on their colleagues.

While the Puerto Rican print, electronic media and radio
provided full coverage of this extraordinary militaristic operation, the
U.S. press was virtually silent,(12) with only a few newspapers reprinting
slightly differing versions of an Associated Press wire story.

Reaction from the Puerto Rican Government

After the September assassination, the FBI lost all hope of
credibility in the eyes of Puerto Rican society. Having been told on
February 10 only after the FBI had begun its assault, and only that they
were serving search warrants on suspected Macheteros, the chief of police,
Pedro Toledo (himself a former FBI agent), as well as the head of the
Department of Justice were quick to distance themselves from the operation,
making public statements that they were not participants.(13) When Toledo
learned–after the operation was over– that the FBI asserted that this
"ongoing domestic terrorism investigation" averted "a potential attack,
where explosives devices were to be utilized," to be "directed at privately
owned interests in Puerto Rico, as well as the general public,"(14) he
insisted that, "[w]ithout a doubt, I should have been informed."(15) Toledo
rather resoundingly criticized the entire operation– not just the use of
force against the journalists– as having used excessive force, listing the
use of so many agents and the incorporation of helicopters. He recalled his
own participation in the 1980's in executing search warrants against members
of the same clandestine organization, when such incidents never took place.
"It was an improper use, completely outside of the norm. This gas (pepper)
is used when your life is in danger, against an attacker, not a journalist,"
he said.(16) However, although he expressed that the Puerto Rican Department
of Justice would have jurisdiction to prosecute federal agents for their
excessive use of force, he did not express any intention to conduct such a
prosecution, or even investigate these FBI crimes on Puerto Rican soil.

The governor was another recipient of such a "courtesy call," (17)
which also took place only after the FBI had begun its assault.(18) He, too,
expressed indignation at the assault on Puerto Rican journalists, calling it
unjustified.(19) However he offered absolutely no criticism of the FBI's
invasion of his country, let alone of the agency's failure to even notify him
in advance, and failed to insist that the U.S. government be accountable
for the acts of its agents committed in Puerto Rico.

Reaction from the Public

The very same afternoon the FBI conducted its show of force,
hundreds of people gathered at the federal courthouse, which houses the
FBI offices, to express their indignation. Called by the Worker's Socialist
Movement [MST by its Spanish acronym], (20) people of all ages and walks of
life marched and chanted, as elected officials, spokespeople from a variety
of organizations, and those whose homes had been ransacked, spoke.

The following day, fifteen organizations convened a press conference
to condemn the FBI's aggressive presence. A spokesperson for CEDECO's
support network expressed concern that the highly publicized raid could
cost the organization the financial support it receives from grants and
foundations and thereby undermine its ability to offer services of education
and of rehabilitating homes for people with few resources. Agency
spokespeople questioned why the FBI would take important documents
related to one of CEDECO's urban housing projects.(21)

Julio Fontanet, president of the Puerto Rican Bar Association,
expressed a common theme: "To complain to the federal government or the
government of Puerto Rico is an exercise in futility, and the FBI acts with
total impunity in Puerto Rico."(22) Observing that this type of FBI operation

in Puerto Rico has become a custom, Fontanet announced his intention to take
the matter to international fora.(23) The former dean of the Eugenio María de

Hostos School of Law, law professor Carlos Rivera Lugo, echoed Fontanet,
censuring the Puerto Rican government "for permitting the U.S. armed forces
to act with total impunity in this country."(24) The National Hostosiano
Independence Movement coincided: "The governor of Puerto Rico has the
obligation to stand up and defend Puerto Rico. We demand that governor
Aníbal Acevedo Vilá energetically condemn the FBI's abusive actions in
Puerto Rico, and that as a representative of the people he express the
general indignation we all feel, and that he demand respect for our
people."(25) The experience moved that organization to commit to redouble its

efforts to "expel forever from our national territory the federal court and
the FBI," because "the only thing the presence in Puerto Rico of these
federal dependencies has caused is injury, damage, and impediments to our
right as a people to self-determination."(26)

Amnesty International of Puerto Rico expressed its concern for
the FBI's conduct both in executing the search warrants and attacking the
press, reminding the FBI that they are not above the law of civil and human
rights, and that, like any other law enforcement agency, they must comply
with basic human rights provided by international law.(27)

Representatives of all the political parties have, however
timidly, expressed preoccupation with the FBI's conduct toward the
independence movement, but it was the independence party representative who
expressed the sentiment strongly felt throughout the diverse independence
movement: "This operation is the most crude proof that Puerto Rico is a
colony," noted Juan Dalmau, secretary general of the Puerto Rican
Independence Party.(28) "If the FBI thinks that with these acts it is going
to intimidate the independentists, it is mistaken. In the face of these
abuses, the independence movement will respond just as it has historically,
with more militancy, more patriotism and a greater commitment to
struggle."(29) That will be necessary, given the rumors that the FBI will
return to conduct more search and destroy missions,(30) and to increase the
wave of repression.
'El' Jazeera
By Kelly Hearn
AlterNet

Friday 13 May 2005

To balance the anti-Chavez local press and pro-American CNN, Venezuela is launching a South American Al Jazeera. With journalistic heavyweights and an non-corporate vibe, the channel arrives on the scene as a number of Latin American nations are leaning politically left.

Move over Al Jazeera, Telesur is here.

Venezuelan President Hugo Chavez, tireless polemist and Bush nemesis, has a new pet project: a continent-wide television network slated for broadcast throughout South America in the coming weeks.

Telesur, or "Television of the South," aims to be a competitor of CNN, Univison and other global giants seen by southern neighbors as minions of American hegemony.

Described by its new director, Aram Aharonian, as South America's "first counter-hegemonic media project," Telesur reportedly has 20 employees but hopes to work its way up to at least 60. The Chavez government has coughed up $2.5 million for the project thus far and is permitting Telesur to operate as an affiliate of Venezuelan state television.

Telesur is painted in populist hues, befitting a World Social Forum keynoter. A kind of Al Jazeera of the South, the commercial-free, state-funded channel will beam news, documentaries and other programming with a uniquely Latin flavor. The network will be boosted by the presence of journalistic heavyweights -- among them, Jorge Enrique Botero, a well-known television producer known for his coverage of FARC rebels.

The Vibe?

Forget coats, ties and corporate coif. Telesur's lead anchorwoman, Ati Kiwa, an indigenous Colombian woman, will deliver news while in native dress.

Telesur will compete for hearts and minds of viewers as a number of Latin American nations are leaning politically left, miffed both by Washington's neglect of the region and U.S.-backed neoliberal economic policies, widely seen as the cause of the devastating recessions of the early 2000s.

For Chavez, Telesur is about more than broadcasting. The continent's prime lobbyist for hemispheric cooperation as a counterbalance to U.S. power, the democratically-elected Chavez touts Telesur as a high-tech thread for binding regional cultures into a seamless fabric capable of balancing U.S. dominance.

He's found supportive ears.

In February, Argentina's president, Nestor Kirchner, committed his country, among other things, to buying up 20 percent of the company's initial equity stock, providing 100 hours of programming and using its satellites to beam Telesur across its territory. In Uruguay, one of the first acts of the country's new Socialist president, Tabare Vasquez, was to commit his nation to 10 percent of Telesur's start-up costs. And the Venezuelan government says Brazil and Cuba have agreed to share in programming and swap technical training.

Some say South America has long needed its own cultural conduit but they worry Telesur could devolve into a Chavista rant machine.

History bears warnings. Chavez, whom the Bush administration accuses of undemocratic behavior on several fronts, already uses Venezolana de Television, his country's state-run TV, to promote his agenda. The station gives Chavez a platform every Sunday in a one-man show called "Alo, Presidente."

But a new report by The Council on Hemispheric Affairs (COHA), a Washington-based think tank, says Venezuelan state television only has 2 percent of market share. It's Venezuela's private media, which supported a 2002 coup against the former military colonel, that actually hogs market share. (Incidentally, the main media power in Venezuela is The Cisnero Group of Companies, owned by Gustavo Cisneros, one of Latin America's wealthiest men and a friend of George Bush, Sr.).

To help state TV better compete with folks like Cisneros, the Chavez government, according to the COHO report, plans to invest $56 million in its state run television enterprise (which will no doubt benefit Telesur).

Though Chavez needs Telesur to elbow in on private media, Nikolas Kozloff, the COHA analyst who authored the report, say it's not a forgone conclusion that Chavez will kidnap Telesur for his own ends.

In fact, Kozloff says he has studied columns written by Telesur's leading journalists and they seem mindful of the need to maintain editorial independence. And there are hints that could happen. Kozloff says, for example, that Aram Aharonian, Telesur's general director, has been "a bit critical of Chavez in the past."

Ties that Bind?

Instead of moving over, Al Jazeera may be moving in, with Telesur that is.

As Telesur gets set to launch, the Arab-language news program Al Jazeera, which is funded by oil-rich Qatar, is expanding into Latin America, opening a bureau in Caracas and possibly creating logistical ties with Telesur.

An article posted on a Venezuelan government web site refers to Al Jazeera's expansion into South America as "being framed within the Telesur-Al Jazeera project."

A spokesperson for Al Jazeera said he could not confirm that the two networks have signed any deals between them but said it is possible that the two state-funded enterprises could be cooperating logistically. Kozloff says it is his understanding that Telesur has entered a deal to extend office space to Al Jazeera in Telesur's headquarters.

Experts note that trouble can arise when nations control media outlets.

"All media financed by states are susceptible to pressure and government orientations if regulations are not established that guarantee editorial autonomy," said Jaime Abello of The Foundation for New Ibero-American Journalism, a Colombia-based group founded by Gabriel Garcia Marquez.

Abello says it is unclear whether Telesur has established "rules of the game" that will ensure independence.

Jorge Ramos, the popular broadcaster for the Spanish language, Los Angeles-based Univision, has his own worries.

"Chávez already controls almost everything in Venezuela, the assembly, the constitution, the Supreme Court and the army," Ramos writes in an essay posted on his web site (www.jorgeramos.com). "Through Telesur he could expand, without control, his international agenda."

Kozloff strongly cautions against jumping to conclusions, however, noting that BBC, which is also a state run media, has not been hijacked by its state funders to any obvious degree. And the involvement on Telesur's board of directors of representatives from center-leftist governments such as Argentina, Brazil and Uruguay, which steer far clear of extreme populism and have amiable relations with the United States, could well counter any attempts by Chavez to use the network to promote his personal agenda.

Congressman Connie Mack, R-Fla., a Chavez critic, shared his concerns in a telephone interview:

"An Al Jazeera-type network in South America sounds like Chavez wants to poison the minds of people longing to be free," Mack said. "The steps he has taken over the last couple of months, and even before that, point to someone who is more interested in his own power than the welfare of his people."

But millions of South Americans are bound to disagree. To many on this continent, the real "mind poison" flows through CNN and other vectors for spreading American cultural and political hegemony.

Independent media like Pacificar, a newspaper distributed in several South American nations share this view as well, editorializing that Telesur: "[will] be a triumph in the extensive battle to establish a new informative world order to replace the existing one controlled by a quasi-monopoly of the United States and European Union."

And who knows -- 30 years down the line Telesur may just be under attack by its government benefactors for being too critical, like another public broadcasting venture we're all familiar with.

So the question I pose to the community is, if you were offered access to test equipment... perhaps even someone from the community offered to check things out for you... would that be something that you would consider? Obviously this would be more of a barometer than an endorsement. It would certainly be non-legally binding. At most, it would be a best-guess or advisory thing. But some information about your station's spectral purity and modulation characteristics is better than none, right? If offered, would anyone even pursue this option?

The Return of Low-Power FM
Does a tiny station in Nashville signal the future of community radio? -By
Danielle Maestretti, Utne.com May 5, 2005 Issue

In recent years, consolidation of the airwaves (think Clear Channel, which owns and operates more than 1,200 stations) has proved a sizable threat to community radio. Locally run stations are shut down when larger broadcasters cry "interference," and to cut costs, corporate-owned "local stations" are often run hundreds of miles away from the communities they serve. That means
citizens hear less local news and less about local happenings -- ultimately cutting people off from ways to get involved in their communities.

Jim Ridley, writing for Nashville Scene, documents a hard-won victory for community radio -- the launch of Radio Free Nashville. Now one month old, it is Nashville's only community-owned and -operated radio station. Much of its programming is decidedly liberal (the "Democracy Now" broadcaster is the state's only Pacifica Radio affiliate). But its programs range from the political to the musical ("pulp country" on Wednesdays, funk on
Thursdays, hoedown on Fridays) to the entirely apolitical (including Will Reynolds' weekly NASCAR report and fire department lieutenant Walter Bell's Monday morning multicharacter radio plays about fire safety).

The success of Radio Free Nashville, a low-power FM station (LPFM)
broadcasting on a 100-watt signal, may soon be echoed by others. While current Federal Communications Commission regulations make it difficult to acquire LPFM licenses -- largely because of bullying by the National Association of Broadcasters -- several pro-independent media organizations
are drawing attention to LPFM's potential. Prometheus Radio Project, a Philadelphia-based organization whose volunteers helped get Radio Free Nashville up and running, provides detailed information about LPFM, including how to apply for a license and how to wrangle with the FCC.

There's hope on the legislative front as well. In February, Senators John
McCain (R-Ariz.), Patrick Leahy (D-Vt.) and Maria Cantwell (D-Wash.) introduced the Local Community Radio Act of 2005. The bill would expand LPFM service nationwide, easing the burden on would-be LPFM stations to prove noninterference with commercial broadcasters.

Radio Free Nashville's slogan, "Low power for the people," may indeed hail the future of community radio.

Here is whole story...

Here's the skinny on our hearing on Friday:
9 AM, Federal Bldg 450 Golden Gate @ Polk. 19th floor, courtroom 10
This is the last hearing we will have in federal court. The case
stands as follows:
Sara Winslow, US Attorney, is arguing that SFLR broadcasted illegally,
so the FCC was justified in entering a private home and seizing the
radio stuff. SFLR is arguing that the law that the FCC used to enter and
seize, a 19th century maritime law designed to permit government agents
to surprise and board ships carrying contraband in the harbor, isn't a
proper legal basis for raiding a house, being as a house is not a ship
and no illegal drugs or aliens were found. It's possible that both
sides will win! If that happens, then the judge will decide whether the
FCC's case is stronger than ours...or which is more fundamental, or
something like that. Ideally we will be able to argue our case in front of
the Ninth Circuit where federal policy change is possible.
Come and support your friendly neighborhood radio underdogs!
Ninth Circuit or bust!!

Join us on Friday January 21st, starting at 7 o'clock at the Felton Community Hall, for a showing of the Coen Brothers film O Brother, Where Art Thou? A benefit to create an independent community radio station in the San Lorenzo Valley. An interesting and inspiring evening of film, music, speakers, food, and community.

It is also a chance for Felton residents and others in the San Lorenzo Valley to get involved in independent media and support their own community radio station. With the ongoing water ownership struggle, we are ready for more local independent voices in our community.

We'll be joined by Felton FLOW, Free Radio Santa Cruz, Santa Cruz Indymedia Project, and Santa Cruz Guerilla Drive-In to talk about the desperate need for independent media.

We'll have live music by local old-timey musicians, several short films, and our feature film, O Brother, Where Are Thou? We'll have cookies, drinks, beer and wine, and delicious popcorn.

Donations of $5 will be accepted at the door. No one turned away for lack of funds and no generous donations refused.

To get there: From Santa Cruz: Go up Graham Hill, Left at Hwy 9, Felton Community Hall is on your right at 6191 Highway 9, Felton.

Background on Low-Power FM Radio

Until 1982, there were low-power (under 100 Watts) unlicensed FM stations in communities all over the country. At that time, Congress passed the Telecommunications Act of 1982 making unlicensed low-power FM stations illegal. The FCC turned over our airwaves mostly to corporations who could afford the millions of dollars that these increasingly expensive FM stations fetched. Thousands of locally-run, low-power independent community radio stations went dark in 1982.

With media consolidation one company now can own dozens of radio and TV stations in one area, virtually controlling the news and information for whole communities. ClearChannel and Viacom are two examples. In the last month, for instance, FoxNews contracted to provide all of the news heard on the 1500 radio stations owned by ClearChannel nationwide. Naturally, one company owning all of the media reduces the diversity of voices heard in local communities and seriously threatens the idea of a free press.

Strictly speaking, an unlicensed station is not currently legal. However, through this simple civil disobedience, FRAM is working to change the law that turns over control of our airwaves to largely corporate interests.

About the Felton Radio Access Movement

FRAM is an autonomous collection of Felton residents who want more local access to independent alternative media. Following in the footsteps of the Santa Cruz Radio Access Movement (SCRAM) who returned Free Radio Santa Cruz to the airwaves after their shutdown by the FCC, we will be creating a local Felton Free Radio node to give voice to our local issues and struggles.

Powell to step down as Chairman of FCC, officials say

From New York Times, January 21, 2005
By Stephen Labaton and John O'Neil

WASHINGTON, Jan. 21 - Michael K. Powell will step down today as chairman of the Federal Communications Commission, officials there said, ending a four-year term that was marked by the tightening of standards on decency and attempts to loosen restrictions on media ownership.

Mr. Powell was appointed to the commission in 1997 by President Bill Clinton and promoted to chairman by President Bush in 2001. Associates of Mr. Powell's have reported for months that he planned to leave after the conclusion of Mr. Bush's first term. His decision to announce his retirement today was reported this morning in an editorial in The Wall Street Journal.

The replacements being considered for Mr. Powell are said by administration officials to include another Republican member of the commission, Kevin Martin; Becky Klein, a former head of the public utility commission in Texas; Patrick Wood III, the head of the Federal Energy Regulatory Commission; and Michael Gallagher, head of the National Telecommunications and Information Adminstration in the Commerce Department.

It was not clear when Mr. Powell would actually leave his post.

Mr. Powell, a Republican, brought an emphasis on deregulation to the commission. The most contentious issue of his term came with his proposal to relax the rules limiting how many media outlets one company could own in any given city.

The change was supported by big broadcasting and publishing companies and vigorously opposed by a coalition of smaller broadcasters and labor, consumer and civil rights organizations. It passed in June 2003 along a party-line vote, but was blocked last year by a court that said the commission had failed to justify the ruling.

Among the broader public, Mr. Powell was better known for the crackdown on indecency on the airwaves that he led after the Super Bowl incident in which singer Janet Jackson bared a breast on live television in 2004.

The fines that followed were something of a departure from Mr. Powell's reputation when he took over as chairman, when he was hailed by broadcasters for his position that it was unfair to impose standards on them that their competitors in cable and satellite television did not face.

Mr. Powell said the fines were made necessary by an "increasing coarseness" in programming driven by a quest for ratings, while the broadcasting community called him the most heavy-handed enforcer of speech restrictions in decades.

Mr. Powell faced criticism from conservatives as well for not being even tougher, including from another Republican member of the commission, Kevin J. Martin.

Mr. Martin was also behind a rare defeat for Mr. Powell, when the commission turned down his proposal in 2003 to deregulate the local telephone market.

Mr. Powell, 41, is the son of Secretary of State Colin L. Powell, who is also stepping down from his post. The younger Mr. Powell followed his father's footsteps by joining the Army, but went to law school after being severely injured in a jeep accident in Germany.
>
> You're Invited To Low Power Radio Day at the FCC --
> 5 Year Birthday Party For Real Community Radio!
>
> (Please read this note to learn about an amazing opportunity to fight
> for community radio in Washington, DC, February 8th, 2005! And
forward
> widely!)
>
> On the morning of Tuesday, February 8th, 2005, the Federal
> Communications Commission is inviting Low Power FM radio broadcasters
> and their allies to attend an important meeting in Washington, DC.
We
> worked hard to establish the service in 2000, and five years later,
the
> FCC wants to see how well these important news stations have survived
> and thrived. How can they make the service better? How can they help
> your stations work better for you and your community?
>
> Leading Low Power FM radio stations from across the country will
> testify
> before Chairman Michael Powell, and other Commissioners and staff.
> Everyone is invited -- so this is a great opportunity to make sure
that
> you can share your station's struggles and successes with the biggest
> decisionmakers in radio. Allies across the movement for a more
> democratic media and longtime friends -- please help us make sure it
> grows and thrives over the next five years. Help us fight to bring
> community radio to those who the FCC has left out.
>
> To help make your trip to DC even more worthwhile, Prometheus will
> organize a full day of workshops, trainings, and information sessions
> for Monday, February 7th. Prometheus staff, board, and some of the
> best-informed experts on everything from underwriting to antennas
will
> be on hand, as we focus on building skills for advocacy, and planning
> our campaigns for Low Power FM radio expansion.
>
> That night, starting at 7pm, the fun begins, as we celebrate Low
Power
> FM radio's 5th birthday! Stations from around the country will show
> pictures, audio clips, and stories from their wonderful stations, as
we
> celebrate, and work together to bring community radio to every town
> that
> needs it.
>
> And before you go home, Prometheus will make sure that you get to
meet
> with your elected officials' offices in Congress and the Senate to
> discuss the expansion of the Low Power FM radio service.
>
> More details about these exciting few days, and an official
> announcement
> from the FCC are forthcoming! Please let us know if you are coming,
and
> if you are interested in bringing photos, audio clips, program
> schedules, flyers and posters, etcetera.
>
> All events will be free, and Prometheus can help to find free housing
> with sympathetic local radio advocates for those who need to minimize
> their expenses -- but let us know as soon as possible if you need
help
> with housing. We cannot guarantee free housing if you do not respond
> by
> January 30th!
>
> So, buy your plane tickets now, and we hope to see you:
>
> Monday, February 7th: 10AM-4PM for the LPFM Training Day
> Monday, February 7th: 7PM-10PM for the 5th Birthday of Low Power FM!
> Tuesday, February 8th: 9:30AM-12:30PM for Low Power FM radio day at
http://news.yahoo.com/news?tmpl=story&u=/ap/20041206/ap_en_bu/clear_channel_fox_12

Clear Channel Chooses Fox for News Deal

SAN ANTONIO - Clear Channel Communications Inc., the nation's largest radio station operator, has selected Fox News Radio to provide national news for most of its news and talk stations in deal expected to nearly double Fox's radio presence.

No terms of the five-year cash deal were disclosed Monday. But Fox, a unit of News Corp., said if all options in the agreement are exercised, its radio service could have more than 500 affiliates by the middle of next year.

The deal helps Fox News compete with more-established radio news providers, including ABC Radio and CBS Radio. Fox News will air on many of Clear Channel's most prominent news and talk stations, including those in Los Angeles, Phoenix, Atlanta and San Diego.

Fox currently provides one-minute newscasts to 275 stations. Starting next year, it will provide more than 100 Clear Channel stations with a 5-minute newscast at the top of each hour, a nightly news broadcast and serve as San Antonio-based Clear Channel's primary source on breaking national news.

In return, Fox News Radio will have access to news produced by local reporters for Clear Channel stations. Fox also expects to hire more news anchors, studios and staff, but it said it was too early to be more specific.

"This deal positions Fox News to become a significant player in the radio industry and is another example of our commitment to the medium," said Roger Ailes, Fox News chairman and chief executive.

John Hogan, chief executive of Clear Channel Radio, said in a statement that local stations would get higher quality national news.

Clear Channel, which operates 1,200 stations, did not immediately return a phone call seeking additional comment.

Analysts said that ABC Radio, which is owned by The Walt Disney Co., stood to lose the most because of the Fox-Clear Channel deal. ABC Radio did not immediately return a message seeking comment.

Experts also speculated that Fox might have won the deal by taking cash instead of barter. Often in the radio industry, providers such as Fox get advertising spots that they can resell.

Clear Channel has been reducing advertising time in an effort to boost rates and probably wanted to keep its dwindling but perhaps more valuable inventory of ad spots, they said.

"Cash makes sense" for Clear Channel, said David Bank, an analyst with RBC Capital Markets. "Rather than give away inventory that is getting more scarce, (Clear Channel) preferred to pay cash."

James C. Goss, an analyst with Barrington Research, said Clear Channel wants to keep cutting advertising and Fox wants to grow as a news source. "They're both accomplishing what they want," he said.

Clear Channel shares rose 48 cents, or 1.4 percent, to close at $33.63 on the New York Stock Exchange (news - web sites) — toward the low end of their 52-week trading range of $29.96 to $47.76.

Shares of News Corp. slipped 8 cents, or 0.4 percent, to $18.09 on the NYSE. The stock has traded between $17.16 and $39.74 in the past 52 weeks.

RVR URP FM Radio Broadcast Transmitter Exiter Portable
Ends Sep-04-04 12:15:08 PDT

These are good, professional quality, FCC type accepted LPFM transmitters. The output power is adjustable between 0-10 watts and they run from 12 volts! Perfect for portable operation or emergency broadcasting. Like many professional transmitters they are mono (for stereo you have to supply a composite input from an external audio processor). Will accept either mic or line level input through XLR jack. Can be easily set to any frequency in a second from the front panel. At this price point, the quality is hard to beat. Typical retail cost was over $1000 (for the transmitter alone); in this case you get the portable magnetic mount antenna, a battery as well as a cary bag.
For those not familiar with RVR they are essentially the same as BEXT (just a different sticker, same guts).

If you are looking for a good, clean, low power, mobile transmitter, this is it! Get 'em while you can. (No, I don't know the seller, or have any connection with them).

2004 JAMES MADISON FOI AWARD WINNERS

NORWIN S. YOFFIE CAREER ACHIEVEMENT AWARD

Daniel Ellsberg
In the 33 years since his release of the Pentagon Papers, Ellsberg has
continued to write and lecture on the dangers of excessive government
secrecy. In 2002, he published "Secrets: A Memoir of Vietnam and the
Pentagon Papers," which exposes the official culture of secrecy and how
it distorts the policy-making process. For a generation, Ellsberg's
courage in leaking the Pentagon Papers has served as inspiration for
countless other journalists, whistleblowers, and freedom of information
advocates in their own battles against government secrecy.

JOURNALIST

Kim Curtis and Robert Porterfield, Associated Press
Curtis and Porterfield made extensive use of the Public Records Act in
investigating California's compliance with Megan's Law. They ultimately
discovered that the state had lost track of more than 33,000 convicted
sex offenders. The report prompted newspapers in several states to
investigate their own state's compliance.

A call to arms. So... If some engineer with an interest in pirate radio were to purchase a nice transmitter, something fairly illegal, say- With a 30 mile radius?
If said radio station was putting out effective investigative reports from reliable news sources about americas involvement with oil drugs and war throughout the world (for the many who don't know and believe everything they here on TV is true) Then it would be likely investigated, triangulated and promptly shut down.
So say this engineer had the dough to drop on THREE 30 mile transmitters, each one placed a few miles apart and set switch active transmission between the three at predetermined intervals, (palmtop on each switching the signal on and off on a predetermined cycle) Effectively switching the signal off from any single transmitter before any triangulation would be possible, how long do you think it could ward off the FCC if they were actively on the prowl? Do they have the equipment readily available to track three seemingly-random occilating transmitters albeit carrying the same signal?
I know someone who can build it, question is, theoretically, would it work? I don wanna type up all the technical stuff till I have equipment and a soldering iron in my hands.

What do you think pirate radio tribe? Someone outta give it a go.

John Hell here. Just got on this thing recently and I started a SFLR tribe too. I want to get pirate/micro radio network going. I believe the best way to fight the feds is to come together under the same umbrella.

Right now SFLR is beginning a legal fight that can change the way radio is looked at in this country. We may be only broadcasting via the internet today, but the day will come when we'll be able to hoist that antenna up high.

I'd like to know if anyone here is interested in connecting a .10 watt transmitter to their computer and broadcasting our internet stream?
A discussion about the has begun at: http://liberationradio.tribe.net
anyway, i guess i should just get a prefab transmitter with less watts? i have a comet antenna and i nice high roof so how many watts do you think i will need to transmit for a 10 mile radius? they say 5-10 watts but i dont know if that is enough juice or what. i have a 12 volt power supply and i want to be able to use it so i cant get something that wont take my load.
if you think i should get a different (prefab) FM transmitter, do you have any suggestions on a good one? i cant really find anything that isnt around 600 bucks more.
any insight would be greatly appreciated (or if you have an old fm exciter i could possibly get off of you that would be fantastic too)
The 8100A was (and many would argue still is) one of the finest processors around, many are still in use. The XT-2 gives you even more smash and it's all analog so you don't have to deal with the digital grudge. Fine piece of very professional gear. Watch this price, anything under $1200 is a score, at $20 it's a deal of a lifetime!
The brick *hithouse of stereo gens. They work and can take a beating. These things are heavy too, so not for your backpack rig. Not a bad price though.
Not a bad amp, needs external components.
CATEL FMX-2100 RF modulator
Listed as a LPFM FM Transmitter "Exciter" [yeah right] set to 106.7 MHz. Pried at a crack smoking $172.50
11 bids so far and 1 days 6 hours left to go.

People please... this is a CATV modulator.

If anyone is interested in the TV version of this unit I have one which I would gladly part with at a much lower price. I think it is rocked up for Ch 2.
